Quick answer

A business loan can pay an overdue ATO debt in full, stopping further general interest charges and reducing the risk of firmer ATO action. With property security, $20k to $250k is possible on the same day and up to $5m within 24 to 48 hours. ATO debt itself is considered case by case, so having tax debt doesn't rule you out.

Key points

Why pay ATO debt quickly rather than letting it ride?

Because ATO debt gets more expensive and more stressful the longer it sits. The general interest charge (GIC) accrues daily on overdue amounts, and from 1 July 2025 GIC and shortfall interest charge are no longer tax deductible. That removes the small cushion owners used to count on.

Beyond cost, a growing tax debt narrows your options. The ATO has a range of firmer actions it can take on businesses that don’t engage, including garnishee notices to your bank or customers, director penalty notices for unpaid PAYG withholding or super, and reporting large overdue business tax debts to credit reporting bureaus. None of those help a business trying to trade through a tough patch.

How fast can a loan clear an ATO debt?

With property security, $20k to $250k is possible on the same day, and up to $5m within 24 to 48 hours. Funds can be paid straight to the ATO at settlement. For smaller debts, a trading business may be able to use an unsecured loan, with same-day funding possible for smaller amounts.

Debt size Likely fast route Speed possible
Smaller, no property Unsecured cash-flow loan Same day for smaller amounts
$20k – $250k, property Caveat loan or second mortgage Same day
$250k – $5m, property Second mortgage or first mortgage 24–48 hours

Loan or ATO payment plan?

The ATO offers payment plans, and for some businesses they’re the right answer. But plans have limits. Interest keeps accruing, missed instalments can cancel the arrangement and the ATO may not agree to a plan at all if earlier plans have defaulted. A loan pays the ATO in full, closes the matter and replaces it with a commercial debt on terms you’ve agreed to.

Ask your accountant to compare the two side by side. Look at total cost over the expected time, what each does to your monthly cash flow and the risk of the ATO escalating.

Will my ATO debt stop me getting a loan?

No, not automatically. ATO debt is considered case by case. Lenders look at how the debt arose, whether lodgements are up to date and whether the business has a believable path forward. Property security makes the biggest difference. If your lodgements are behind, get them done or at least underway, because lenders need to know the real size of the debt.

What do I need to move fast?

  1. An ATO statement of account showing the current balance, downloaded from online services
  2. Your ABN and photo ID for each director
  3. Recent business bank statements
  4. For secured loans, property details and current mortgage statement
  5. Any ATO correspondence, such as a director penalty notice or garnishee notice

If you’ve received a director penalty notice, tell the specialist on the first call. Deadlines in those notices matter. Read more in our tax-time cash crunch guide.

Illustrative example: a Sunshine Coast building company owes $180,000 across BAS and PAYG withholding. The ATO has issued a director penalty notice. The director owns a home with good equity. A caveat loan paid directly to the ATO clears the debt, with same-day funding possible once ID, the ATO statement and signatures are ready.

What about the tax bills still to come?

Clearing old debt only works if new debt doesn’t pile up behind it. Set aside GST, PAYG and super as they’re collected, ideally in a separate account. Lodge on time even if you can’t pay in full. Our page on BAS and GST bills covers how to fund a single quarter without letting it turn into a long-term debt.

What if the debt is already under a payment plan?

A loan can still pay it out. Some owners take a plan, find the instalments squeezing cash flow, and decide one commercial loan is cleaner. Download the current balance from online services before you enquire.

Frequently asked questions

Can I get a loan if I already owe the ATO?

Yes. ATO debt is considered case by case, and paying it off is one of the most common reasons owners take a fast business loan. Property security helps most.

Is a loan better than an ATO payment plan?

It depends on the size of the debt, your cash flow and the ATO's terms. A payment plan suits some businesses. A loan suits others, particularly where the ATO has escalated or where interest charges are building. Ask your accountant to compare both.

Is ATO interest still tax deductible?

Not for general interest charge and shortfall interest charge incurred on or after 1 July 2025. That makes carrying ATO debt more expensive than many owners assume.

Can the loan be paid directly to the ATO?

Yes. At settlement, funds can be paid straight to your ATO account using the correct payment reference.

What happens if I ignore a large ATO debt?

The ATO can take firmer action, such as garnishee notices, director penalty notices or reporting large business tax debts to credit reporting bureaus. Acting early keeps more options open.
